End-User License Agreement (EULA) for Maritime Master - Skipper

Please read this End-User License Agreement ("EULA") carefully before using the Maritime Master - Skipper mobile application ("the Application") operated by Maritime Master Limited, formerly known as Bottle Top Studios Ltd, a company registered in England and Wales under company number 15339200 ("Maritime Master", "us", "we", or "our").

By downloading or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not download or use the Application.

1. License Grant

Maritime Master grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application on devices that you own or control, solely for your personal, non-commercial recreational boating education and skipper-level training, study, and revision purposes, strictly in accordance with the terms of this Agreement.


2. Restrictions

You agree not to, and you will not permit others to: a. License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Application or make the Application available to any third party. b. Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Application. c. Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Maritime Master or its affiliates, partners, or licensors of the Application.


3. Disclaimer of Warranties

The Application is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Maritime Master, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Application, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice. Without limitation to the foregoing, Maritime Master provides no warranty or undertaking, and makes no representation of any kind that the Application will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected.


4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Maritime Master or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the Application, third-party software and/or third-party hardware used with the Application, or otherwise in connection with any provision of this Agreement), even if Maritime Master or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.


5. Specific Disclaimers for Training Tools and Information

THIS APPLICATION IS INTENDED SOLELY FOR TRAINING AND LEARNING PURPOSES AND MUST NOT BE USED FOR ACTUAL NAVIGATION, PASSAGE PLANNING, OR ANY OPERATIONAL DECISION-MAKING WHATSOEVER.

a. Interactive Navigation Tools: The interactive tools within the Application (including position fixing, dead reckoning, course to steer, tidal heights and streams, tidal stream atlas, and compass deviation tools) operate solely on values entered by you for practice purposes. They are not connected to GPS, live charts, official tide tables, or any real-time data source. Although they may resemble real navigational instruments and worked examples, they are simulations and study aids only. Reliance on these tools for real-world navigation, passage planning, or collision avoidance is strictly prohibited and dangerous.

b. Calculators: Any calculators included in the Application (e.g., speed-time-distance, estimated time of arrival, dead reckoning, set and drift, compass error, true wind, and unit conversions) are for theoretical training and illustrative purposes only. Their results depend on the values you enter and on simplified models that may not account for all real-world variables, environmental factors, or vessel-specific characteristics. DO NOT use these calculators for actual navigational planning, operational calculations, or any real-world maritime activities. Always use approved, certified, and up-to-date navigational instruments and methods for actual operations.

c. Reference Content: All information, diagrams, guidelines, and content provided within the Application (including but not limited to the COLREGs, IALA buoyage, day shapes and sound signals, VHF channels and radio frequencies, meteorology, glossary, passage planning, and pilotage guidance) is provided for training and general educational guidance only. It is not an official text, and it may not be exhaustive, up to date, or applicable to all specific maritime situations or regulations. Users must always refer to official, current, and authoritative maritime publications, charts, tide tables, regulations, and professional guidance for all actual navigational and operational purposes. This Application is not a substitute for formal maritime training, certification, or practical experience.

d. Emergency Procedures: The emergency procedures quick reference is a study aid only. It is not a substitute for official safety publications, proper safety training, drills, or the instructions of qualified crew, instructors, or the relevant authorities.

e. No Professional Advice: The Application does not provide professional maritime advice, and its use does not create a professional-client relationship. You are solely responsible for your actions and decisions when using the Application.


6. Acknowledgement of Training Purpose

You acknowledge and agree that the primary and sole purpose of this Application is to serve as a supplementary tool for recreational boating education and skipper-level training and learning, such as preparation for and revision of skipper-level courses. It is not designed, intended, or certified for use in real-world maritime operations, navigation, or decision-making, and any such use is at your own sole risk.


7. Intellectual Property

The Application, including all copyrights, patents, trademarks, trade secrets, and other intellectual property rights, is and shall remain the sole and exclusive property of Maritime Master Limited. The Application may include third-party software components that are licensed under their own terms.


8. Apple App Store

You acknowledge that this Agreement is between you and Maritime Master Limited only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Application or its content and has no obligation to provide any maintenance or support services for the Application. In the event of any failure of the Application to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price you paid for the Application; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Application. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you. You represent that you are not located in a country subject to a relevant government embargo and that you are not on any applicable government list of prohibited or restricted parties.


9. Termination

This Agreement will terminate immediately, without prior notice from Maritime Master, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your devices. Upon termination of this Agreement, you shall cease all use of the Application and destroy all copies of the Application from your devices.


10. Governing Law

This Agreement, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with the laws of England and Wales. Your use of the Application may also be subject to other local, state, national, or international laws. Nothing in this Agreement affects any mandatory consumer rights available to you under the laws of your country of residence.


11. Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.


12. Changes to This Agreement

We may update this Agreement from time to time. The "Last Updated" date at the top of this page indicates when it was last revised. Your continued use of the Application after an updated Agreement takes effect constitutes your acceptance of the revised terms.


13. Entire Agreement

This Agreement constitutes the entire agreement between you and Maritime Master Limited regarding your use of the Application and supersedes all prior and contemporaneous written or oral agreements between you and Maritime Master Limited, including any agreement made with Bottle Top Studios Ltd in respect of the Application.
