End-User License Agreement (EULA) for Maritime Master

Please read this End-User License Agreement ("EULA") carefully before using the Maritime Master mobile application ("the Application") operated by Maritime Master Limited, formerly known as Bottle Top Studios Ltd, a company registered in England and Wales under company number 15339200 ("Maritime Master", "us", "we", or "our").
By downloading or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not download or use the Application.
1. License Grant
Maritime Master grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application on devices that you own or control, solely for your personal, non-commercial maritime education, training, and learning purposes, strictly in accordance with the terms of this Agreement.
2. Restrictions
You agree not to, and you will not permit others to: a. License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Application or make the Application available to any third party. b. Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Application. c. Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Maritime Master or its affiliates, partners, or licensors of the Application.
3. Disclaimer of Warranties
The Application is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Maritime Master, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Application, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice. Without limitation to the foregoing, Maritime Master provides no warranty or undertaking, and makes no representation of any kind that the Application will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected.
4. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Maritime Master or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the Application, third-party software and/or third-party hardware used with the Application, or otherwise in connection with any provision of this Agreement), even if Maritime Master or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
5. Specific Disclaimers for Training Tools and Information
THIS APPLICATION IS INTENDED SOLELY FOR TRAINING AND LEARNING PURPOSES AND MUST NOT BE USED FOR ACTUAL NAVIGATION, SHIP HANDLING, OR ANY OPERATIONAL DECISION-MAKING WHATSOEVER.
a. Simulators: The simulators provided within the Application (including the radar simulator, sonar and echosounder simulators, bridge, ship-handling and manoeuvring simulators, and the VHF radio simulator) are simulated tools for educational purposes only. They are designed to help you understand basic principles and practise interpretation in a controlled environment. They do not replicate the full functionality, accuracy, or real-world conditions of actual shipborne equipment, and they are not connected to any real radar, sonar, radio, or navigational systems. Reliance on any simulator in the Application for real-world navigation, collision avoidance, or vessel operation is strictly prohibited and extremely dangerous.
b. Reference Content: All information, diagrams, guidelines, and content provided within the Application (including but not limited to the COLREGs, buoyage systems, lights and shapes, International Code of Signals flags, meteorology, glossary and ship anatomy content, health and safety content, and engineering content) is provided for training and general educational guidance only. It is not an official text, and it may not be exhaustive, up to date, or applicable to all specific maritime situations or regulations. Users must always refer to official, current, and authoritative maritime publications, charts, regulations, and professional guidance for all actual navigational and operational purposes. This Application is not a substitute for formal maritime education, certification, or practical experience.
c. Exams, Quizzes, and Games: Practice exams, quizzes, and educational games within the Application are study aids only. They are not official examinations, and use of the Application does not guarantee success in any examination, assessment, or certification process.
d. Ropework: Ropework and knot content is instructional reference material only. Knots that are incorrectly selected, tied, or loaded can slip or fail and cause injury or damage. Do not rely solely on the Application for any load-bearing, towing, mooring, climbing, or life-safety application; always seek qualified instruction and inspect and test your equipment.
e. No Professional Advice: The Application does not provide professional maritime advice, and its use does not create a professional-client relationship. You are solely responsible for your actions and decisions when using the Application.
6. Acknowledgement of Training Purpose
You acknowledge and agree that the primary and sole purpose of this Application is to serve as a supplementary tool for maritime training and learning. It is not designed, intended, or certified for use in real-world maritime operations, navigation, or decision-making, and any such use is at your own sole risk.
7. Intellectual Property
The Application, including all copyrights, patents, trademarks, trade secrets, and other intellectual property rights, is and shall remain the sole and exclusive property of Maritime Master Limited. The Application includes third-party software components, engine technology, assets, and fonts that are licensed under their own terms and remain the property of their respective owners.
8. App Marketplaces
The Application may be distributed through the Apple App Store and Google Play. You acknowledge that this Agreement is between you and Maritime Master Limited only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Neither Apple nor Google is responsible for the Application or its content, and neither has any obligation to provide maintenance or support services for the Application. Where required by the applicable marketplace terms, Apple and its subsidiaries (for downloads from the App Store) are third-party beneficiaries of this Agreement and may enforce it against you. You agree to comply with all applicable marketplace terms of service, and you represent that you are not located in a country subject to a relevant government embargo and that you are not on any applicable government list of prohibited or restricted parties.
9. Termination
This Agreement will terminate immediately, without prior notice from Maritime Master, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your devices. Upon termination of this Agreement, you shall cease all use of the Application and destroy all copies of the Application from your devices.
10. Governing Law
This Agreement, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with the laws of England and Wales. Your use of the Application may also be subject to other local, state, national, or international laws. Nothing in this Agreement affects any mandatory consumer rights available to you under the laws of your country of residence.
11. Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
12. Changes to This Agreement
We may update this Agreement from time to time. The "Last Updated" date at the top of this page indicates when it was last revised. Your continued use of the Application after an updated Agreement takes effect constitutes your acceptance of the revised terms.
13. Entire Agreement
This Agreement constitutes the entire agreement between you and Maritime Master Limited regarding your use of the Application and supersedes all prior and contemporaneous written or oral agreements between you and Maritime Master Limited, including any agreement made with Bottle Top Studios Ltd in respect of the Application.
