End-User License Agreement (EULA) for Maritime Master - Knots

Please read this End-User License Agreement ("EULA") carefully before using the Maritime Master - Knots mobile application ("the Application") operated by Maritime Master Limited, formerly known as Bottle Top Studios Ltd, a company registered in England and Wales under company number 15339200 ("Maritime Master", "us", "we", or "our").

By downloading or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not download or use the Application.

1. License Grant

Maritime Master grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application on devices that you own or control, solely for your personal, non-commercial learning and practice of knot tying, strictly in accordance with the terms of this Agreement.


2. Restrictions

You agree not to, and you will not permit others to: a. License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Application or make the Application available to any third party. b. Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Application. c. Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Maritime Master or its affiliates, partners, or licensors of the Application.


3. Disclaimer of Warranties

The Application is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Maritime Master, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Application, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice. Without limitation to the foregoing, Maritime Master provides no warranty or undertaking, and makes no representation of any kind that the Application will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected.


4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Maritime Master or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the Application, third-party software and/or third-party hardware used with the Application, or otherwise in connection with any provision of this Agreement), even if Maritime Master or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.


5. Safety Warning and Specific Disclaimers

THE APPLICATION IS AN EDUCATIONAL REFERENCE FOR LEARNING KNOTS. AN INCORRECTLY SELECTED, TIED, DRESSED, OR LOADED KNOT CAN SLIP OR FAIL UNDER LOAD AND CAUSE SERIOUS INJURY, DROWNING, DEATH, OR DAMAGE TO PROPERTY.

a. Not for Safety-Critical Reliance: Some knots described in the Application have uses in climbing, rescue, working at height, towing, mooring, anchoring, lifting, and other load-bearing or life-safety applications. The Application teaches how such knots are formed; it cannot assess your rope, your equipment, your technique, or the conditions of use. Never rely solely on the Application for any safety-critical, load-bearing, or life-saving situation. Always obtain qualified, in-person instruction and supervision before using any knot in such a situation, follow the applicable professional and safety standards, and use certified equipment appropriate to the task.

b. Practice and Verification: Practise every knot with suitable rope in a safe, controlled environment, inspect your rope and equipment before each use, and test every knot under controlled conditions before applying any load. The strength and security of any knot depend on the rope material and condition, the direction and nature of loading, and correct dressing and setting, none of which the Application can verify.

c. Idealised Visualisations: The 3D animations, models, and step-by-step instructions in the Application are idealised representations for learning. Real rope behaves differently, and appearance in the Application does not guarantee that a knot you tie is correct or secure.

d. Indicative Information: Any strength ratings, security ratings, difficulty ratings, usage notes, historical notes, and warnings in the Application are indicative and provided for general educational guidance only. They are not engineering data and must not be used for load calculations or safety assessments.

e. No Professional Advice: The Application does not provide professional maritime, climbing, rescue, or safety advice, and its use does not create a professional-client relationship. You are solely responsible for your actions and decisions when using the Application.


6. Assumption of Risk

You acknowledge that tying and using knots, particularly in marine, climbing, rescue, and other load-bearing contexts, involves inherent risks. You assume full responsibility for any use you make of the knots and techniques described in the Application, and any use of the Application contrary to this Agreement is entirely at your own risk.


7. Acknowledgement of Training Purpose

You acknowledge and agree that the primary and sole purpose of this Application is to serve as a supplementary tool for learning and practising knot tying. It is not designed, intended, or certified for use in real-world safety-critical operations, and any such use is at your own sole risk.


8. Intellectual Property

The Application, including its 3D models, animations, text, software, and all associated copyrights, trademarks, and other intellectual property rights, is and shall remain the sole and exclusive property of Maritime Master Limited. References to knot literature (such as Ashley Book of Knots reference numbers) are bibliographic references only.


9. Apple App Store

You acknowledge that this Agreement is between you and Maritime Master Limited only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Application or its content and has no obligation to provide any maintenance or support services for the Application. In the event of any failure of the Application to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price you paid for the Application; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Application. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you. You represent that you are not located in a country subject to a relevant government embargo and that you are not on any applicable government list of prohibited or restricted parties.


10. Termination

This Agreement will terminate immediately, without prior notice from Maritime Master, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your devices. Upon termination of this Agreement, you shall cease all use of the Application and destroy all copies of the Application from your devices.


11. Governing Law

This Agreement, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with the laws of England and Wales. Your use of the Application may also be subject to other local, state, national, or international laws. Nothing in this Agreement affects any mandatory consumer rights available to you under the laws of your country of residence.


12. Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.


13. Changes to This Agreement

We may update this Agreement from time to time. The "Last Updated" date at the top of this page indicates when it was last revised. Your continued use of the Application after an updated Agreement takes effect constitutes your acceptance of the revised terms.


14. Entire Agreement

This Agreement constitutes the entire agreement between you and Maritime Master Limited regarding your use of the Application and supersedes all prior and contemporaneous written or oral agreements between you and Maritime Master Limited, including any agreement made with Bottle Top Studios Ltd in respect of the Application.
