End-User License Agreement (EULA) for Maritime Master - Whiteboard

Please read this End-User License Agreement ("EULA") carefully before using the Maritime Master - Whiteboard mobile application ("the Application") operated by Maritime Master Limited, formerly known as Bottle Top Studios Ltd, a company registered in England and Wales under company number 15339200 ("Maritime Master", "us", "we", or "our").

By downloading or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not download or use the Application.

1. License Grant

Maritime Master grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application on devices that you own or control, solely for your personal, non-commercial creation of maritime teaching sketches, practice diagrams, and study material, strictly in accordance with the terms of this Agreement.


2. Restrictions

You agree not to, and you will not permit others to: a. License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Application or make the Application available to any third party. b. Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Application. c. Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Maritime Master or its affiliates, partners, or licensors of the Application.


3. Disclaimer of Warranties

The Application is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Maritime Master, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Application, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice. Without limitation to the foregoing, Maritime Master provides no warranty or undertaking, and makes no representation of any kind that the Application will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected.


4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Maritime Master or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the Application, third-party software and/or third-party hardware used with the Application, or otherwise in connection with any provision of this Agreement), even if Maritime Master or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.


5. Specific Disclaimers

THIS APPLICATION IS A SKETCHING AND TEACHING TOOL. NOTHING CREATED IN OR DISPLAYED BY THE APPLICATION IS A NAVIGATIONAL CHART, AND IT MUST NOT BE USED FOR ACTUAL NAVIGATION, PASSAGE PLANNING, OR ANY OPERATIONAL DECISION-MAKING WHATSOEVER.

a. Sketches Are Not Charts: Drawings, diagrams, and exported images created with the Application are informal sketches for teaching, briefing, and study purposes only. They are not official charts or publications, they have no navigational authority, and they must never be used to plan or conduct a passage or to make any decision at sea.

b. Third-Party Map Data: Chart-style backgrounds captured in the Application are generated from third-party sources, including Apple Maps and OpenSeaMap (map data © OpenSeaMap contributors, available under the Open Database License). This material is community-sourced and general-purpose; it is not an official nautical chart, and it may be incomplete, inaccurate, or out of date. We do not control, verify, or warrant third-party map data, and its availability is not guaranteed. Always use official, up-to-date charts and publications for all actual navigational purposes.

c. Symbols: The buoy, mark, and vessel symbols provided in the Application are stylised teaching aids inspired by IALA conventions. They are not official chart symbology, and their appearance may differ from real-world marks and official chart symbols.

d. No Professional Advice: The Application does not provide professional maritime advice, and its use does not create a professional-client relationship. You are solely responsible for your actions and decisions when using the Application.


6. Your Content

You retain ownership of the drawings and projects you create with the Application. Your projects are stored locally on your device; we do not receive, store, or have access to them, and you are responsible for keeping your own backups. You are solely responsible for any content you export or share from the Application, including compliance with the license terms of any third-party map data visible in your exports and for how third parties may interpret or rely on shared material. Exported material remains subject to this Agreement, including the prohibition on use for navigation.


7. Acknowledgement of Purpose

You acknowledge and agree that the primary and sole purpose of this Application is to serve as a supplementary sketching and teaching tool for maritime education. It is not designed, intended, or certified for use in real-world maritime operations, navigation, or decision-making, and any such use is at your own sole risk.


8. Intellectual Property

The Application, including its symbol artwork, software, and all associated copyrights, trademarks, and other intellectual property rights, is and shall remain the sole and exclusive property of Maritime Master Limited. Third-party map data remains the property of its respective providers and contributors and is subject to their own license terms.


9. Apple App Store

You acknowledge that this Agreement is between you and Maritime Master Limited only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Application or its content and has no obligation to provide any maintenance or support services for the Application. In the event of any failure of the Application to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price you paid for the Application; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Application. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you. You represent that you are not located in a country subject to a relevant government embargo and that you are not on any applicable government list of prohibited or restricted parties.


10. Termination

This Agreement will terminate immediately, without prior notice from Maritime Master, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your devices. Upon termination of this Agreement, you shall cease all use of the Application and destroy all copies of the Application from your devices.


11. Governing Law

This Agreement, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with the laws of England and Wales. Your use of the Application may also be subject to other local, state, national, or international laws. Nothing in this Agreement affects any mandatory consumer rights available to you under the laws of your country of residence.


12. Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.


13. Changes to This Agreement

We may update this Agreement from time to time. The "Last Updated" date at the top of this page indicates when it was last revised. Your continued use of the Application after an updated Agreement takes effect constitutes your acceptance of the revised terms.


14. Entire Agreement

This Agreement constitutes the entire agreement between you and Maritime Master Limited regarding your use of the Application and supersedes all prior and contemporaneous written or oral agreements between you and Maritime Master Limited, including any agreement made with Bottle Top Studios Ltd in respect of the Application.
